Trademark Filing — Step-by-step
1. Clearance & Risk Assessment
We run an India-wide and select-class search against registered & published marks, domain names and common law usage to determine registrability and risk.
2. Drafting application (TM-A)
We draft correct specification of goods/services, select classes, prepare the specimen (logo image), and prepare power of attorney if agent filing.
3. Filing & Examination
On filing, the mark is examined. If the examiner raises objections, we prepare a considered reply with legal grounds and evidence.
4. Advertisement & Opposition
If accepted, the mark is advertised for opposition in the Trademark Journal (4 months). If opposition is filed, we handle hearings and arguments on your behalf.
5. Registration
If no opposition or opposition decided in your favor, the mark is registered and a registration certificate is issued.
Common grounds for objection
- Descriptive/specifcation issues (mark describes the goods).
- Similarity with earlier marks likely to cause confusion.
- Lack of distinctiveness for word marks.
Specimen / Logo guidance
Upload a clear high-resolution image (JPG/PNG). For word marks, provide the plain text as the mark. For logos, provide both color and B/W versions if possible.
